AI Policy

1. Purpose and Scope

Jurnal Smart Hukum (JSH) acknowledges the rapid development of Artificial Intelligence (AI) technologies and their potential to assist authors in the academic writing process. This policy aims to regulate the ethical, transparent, and responsible use of AI and AI-assisted tools, in line with JSH's commitment to scientific integrity, originality, and ethical publication standards in the field of law. This policy applies to all manuscripts submitted to JSH.

2. Fundamental Principles

  • Human Accountability: Authors are solely and fully responsible for all content within their manuscripts, including any portions generated, edited, or enhanced by AI tools. AI tools do not meet the criteria for authorship or co-authorship, as they cannot take responsibility for the work.

  • Transparency: Any substantial use of AI tools during the writing or research process must be clearly and specifically disclosed within the manuscript.

  • Integrity and Originality: AI tools must not be used to generate fabricated data, fictitious research results, incorrect citations ("hallucinations"), or plagiarized content. Authors are fully responsible for verifying all AI-generated content.

  • Confidentiality: Authors, reviewers, and editors are prohibited from uploading confidential manuscript content, personal data, or review reports into public, non-secure AI systems.

3. Permitted Use (With Mandatory Disclosure)

Authors are permitted to use AI tools for the following auxiliary purposes, provided that such use is properly disclosed:

  • Language and Grammar Refinement: Using AI to polish grammar, spelling, style, and overall readability of the author's original writing.

  • Non-Substantive Drafting Assistance: Assisting in the initial drafting of non-innovative sections, such as a preliminary literature review to summarize existing publications. The output must be thoroughly verified and substantially edited by the author.

  • Brainstorming and Structuring Ideas: Using AI as a tool to brainstorm ideas, outline a manuscript structure, or explore different perspectives. Authors must independently develop and verify all ideas.

Conditions for Permitted Use:

  1. Authors must clearly state the name of the AI tool used, its version, and the specific purpose of its use.

  2. This statement must be placed in a dedicated "AI Use Statement" section, located before the references. Example statement:

    "During the preparation of this manuscript, the author(s) used [Name of AI Tool, version] for [specific purpose, e.g., improving grammar and readability / drafting an initial literature review outline]. All content generated or suggested by this tool was thoroughly reviewed, edited, and validated by the author(s), who take full responsibility for the final content of the manuscript."

  3. If AI is used as part of the research methodology (e.g., assisting with data analysis), the details of its use, the specific tool, and the author's validation process must be described in the Methods section.

4. Prohibited Use

The following uses of AI tools are STRICTLY PROHIBITED and will be considered a breach of academic ethics:

  • Generation of Substantive Content: Using AI to generate substantive legal arguments, interpretations of statutes, case analyses, or original scholarly contributions. AI cannot replace the critical thinking and legal analysis of the author.

  • Falsification and Fabrication: Using AI to create non-existent or inaccurate data, research results, citations, or references.

  • Plagiarism: Presenting AI-generated content as the author's original work without substantial verification and rewriting.

  • Image/Visual Generation: JSH does not permit the use of images, figures, or visuals wholly generated by AI, due to risks to integrity and copyright issues, unless explicit permission is obtained from the editor and the use is thoroughly documented.

5. Responsibilities and Sanctions

  • Authors are fully responsible for ensuring compliance with this policy.

  • Failure to disclose substantial AI use, or providing a false or misleading statement, is a serious offense.

  • Manuscripts found to be in violation of this policy may be rejected. In cases of severe infractions or repeat offenses, additional sanctions may be imposed on the authors in accordance with JSH's publication ethics policies.

6. Reviewers and Editors

  • Reviewers and editors are PROHIBITED from using AI tools to process or evaluate submitted manuscripts, in order to maintain the confidentiality and integrity of the peer-review process.

  • All editorial decisions must be made solely by humans and must not be delegated to AI.

7. Policy Review

This policy will be reviewed periodically and updated to keep pace with technological developments in AI and best practices in scholarly publication within the legal field. Authors are advised to check the latest version of this policy on the JSH website before submitting a manuscript.

8. Conclusions

The use of artificial intelligence (AI) in the writing of this manuscript is limited to a maximum of 20% of the total content, strictly for grammar checking, limited paraphrasing, or preliminary reference searching, and all final outputs must be fully verified and solely responsible for by the author(s).
